According to an article by The Negotiator, ARLA have advised there is a legislative gap in the Tenants Fees Ban 2019.

'The Gap' means that any payments taken eg. initial rent and deposit before the tenancy agreement is signed is classed as a prohibited payment.

According to ARLA the Tenant Fees Act is drafted in such a way that any money taken prior to the signing of an agreement is treated as a holding deposit. As this is limited to one weeks' rent, any further payments received would be prohibited
